As you can imagine, trying to communicate effectively with 600+ people has its challenges and we have done the best we can under the circumstances. Each human being is unique and every one of them has different needs and questions that they want addressed.
All that residents have done by evidencing their intent to sign the requested Quitclaim Deed and related settlement documents is just that - they have let us know that they are at least considering signing the documents. Those that did so by 11:59:59 p.m. on November 10, 2019 are being asked to sign four settlement documents and those that do so by 11:59:59 p.m. on November 15, 2019 are being asked to sign five settlement documents.
As a result of letting us know that they are willing to consider signing, residents are receiving certain guaranteed protections from us. If they actually sign the applicable settlement documents, they will not be added as parties to the Quiet Title Action individually and they will not be required to pay Bose, Mommies Properties or FH Partners anything that otherwise would be due from them in their individual capacities. If, after reviewing the offered settlement documents the residents decline to sign them, as is their prerogative, they are in the same position they were in before we made this offer and they indicated their intent to consider accepting it.
Believe it or not, there are logistics involved in getting these documents finalized and signed and it is not a simple as printing something off the website and mailing it to me. We need to be sure, for example, that we are dealing with the record title holders to the respective lots in the neighborhood. We also need to make sure the documents are properly witnessed and notarized.
As a result of the foregoing, there is no deadline with regard to returning the settlement documents to us other than doing so within a reasonable time and after we have confirmed who should be signing the Quitclaim Deed. From our standpoint, a reasonable time will be any time in the next week or two as we want to give residents time to consult with counsel should they choose to do so. Incidentally, those who have signed-up are receiving communications directly from Larry Oldham regarding the logistics of finalizing their individual settlements.
