THE SPECIAL MEETING CALLED BY THE HOA BOARD

        One of the neighbors provided me with a special meeting notice from the HOA Board to all members.  As has been typical of most correspondence sent to me by the HOA since we moved into our new home in May of 2005, the HOA apparently sent our notice to our old 4230 High Gables East address since we have yet to receive our notice in the mail.  I sent another letter to the HOA asking it to correct its records regarding my address.  I also sent a letter to the neighbors about the upcoming special meeting and what the HOA members will be able to do at the meeting if they desire.

        While not what I demanded, the special meeting notice is obviously a response to a July 5, 2006 letter I sent to the individual members of the Board letting them know exactly where Lynn and I stand with respect to each one of them and offering to end my crusade against them as long as they resigned their positions and called a special meeting on July 27, 2006 to elect a new HOA Board.  I had intended to keep the letter just between us, but the HOA Board once again found it necessary to provide materially misleading information to the HOA and my best response is to let folks see the thing for themselves.

        I admittedly pulled no punches in the letter and feel it best for all involved for the current HOA Board members to resign from their positions immediately.  I merely let them know that if they did so, they had my word that I would not instigate any further action against them on behalf of the HOA to recover from them the money that they squandered on the needless lawsuit against me.  The special meeting notice speaks for itself, and these folks have the nerve to ask the members to agree to pay $100.00 each to replenish the HOA's reserves that they depleted unnecessarily and in violation of their obligations as fiduciaries.  I guess they did not take too kindly my suggestion that they voluntarily return 1/7 each of the HOA's money that they spent in proceeding against me.  I am hopeful that most of the HOA members will be so incensed at the HOA Board's apparent spending of at least $7,500.00 to collect $212.50 that they will mutiny at the July 25 special meeting, although any of you out there who are familiar with corporate law will understand that the only two matters allowed to be discussed at the July 25 meeting are (i) the request for the special assessment; and (ii) a report on the litigation.
