While I have given up my own individual claims against the HOA and the individuals members of the HOA Board, I believe the HOA members have a valid cause of action against the individual members of the Board for breach of fiduciary duty and unnecessary waste of HOA funds.  While I have not yet decided how (or if) that matter might be pursued by the members of the HOA, I can say that if something is pursued by the members of the HOA, my firm will strongly consider providing the necessary legal services at no charge to those pursuing the claims.  It certainly is in the best interests of the remaining members of the HOA Board to tender their resignations and to call a special meeting for purposes of duly electing a new HOA Board, and it is my sincere hope that the current Board members will see the logic of doing so.
