        I can only hope that someone other than me is asking how the opposing sides can be incurring these kinds of attorney's fees over what is essentially an unnecessary civil action by HOA Board members who are not actually spending their own money that is being defended by a homeowner attorney who thankfully does not have to pay these fees out-of-pocket to his own attorney.  Even so, I make my living selling my time, and the time I have to spend on this matter ends up being lost opportunity costs to me (I intend to start showing my time spent on these web pages as additional compensable time, as I will also be seeking recovery of it when I pursue my claims for abusive litigation).  Please understand that my only "walk-away" option was to pay the HOA's attorney's fees (presented to me as in the neighborhood of $7,000.00 at the time the offer was made), and with my own investment of time and money, I have no choice but to continue to defend myself until this matter is finally resolved, one way or the other.  My best guesstimate of attorney's fees incurred by the respective sides is as follows:

January 15, 2006

        HOA         -- $7,000.00 as of December 30, 2005 (estimated by HOA counsel on
                            December 30, 2005); or

                        -- $9,000.00 (estimated by me based on the December 30, 2005 estimate
                            by HOA counsel and additional work performed by HOA counsel to date)

        Oldham      --$4,000.00 (estimated by me for efforts by me and my firm to date)


March 1, 2006
 

        HOA         -- $9,000.00 as of January 15, 2006 (estimated by me based on the December 30,
                             2005 estimate by HOA counsel and additional work performed by HOA counsel)

        Oldham      --$7,883.50 through February 28, 2006 ($3,837.50 through the end of December)

                        --$8,000.00 in work on this web page if my hourly rate were applied (approximately
                           40 hours since November)

        I received a spreadsheet from Jay Pontrelli on July 19, 2006 that included the following communication with the email:  "Attached is a summary of legal fees charged and paid to date. Specific itemization of work done is subject to the attorney-client and work product privileges, which are being asserted."  I did not prepare this spreadsheet, but by my calculations, this totals $19,852.94 and, as far as I know, does not include any of the time that the HOA's insurance company paid to Peter York's firm, Hawkins & Parnell.
