Please understand that we are not threatening anybody with litigation - Judge Bagley has made it clear that to get the relief we are seeking, we are going to have to include all of the neighborhood residents as parties (see the Default Hearing Transcript before the Honorable Jeffrey S. Bagley at Page 74) and the CRC HOA's attorneys have made that same argument
for different reasons. We can accomplish the same result by obtaining a Quitclaim Deed from each resident and we are offering everyone in the neighborhood the
We are making a simple promise to anyone who does not take advantage of this opportunity. Once we add you as individual parties in the lawsuit, you are going to be involved in it until one of three things happens: (i) Judge Bagley grants us summary judgment against you, in which case you will be on the hook individually for your apportioned share of the damages and attorney's fees we are seeking; (ii) you settle with us, which will be on terms we dictate and which you can be assured will cost you thousands of dollars; or (iii) the jury reaches a verdict, with you being liable for your apportioned share of the damages and attorney's fees we expect to be recovering.
The foregoing applies equally to any of you in the neighborhood that any of us on the Mommies Team know personally - if you do not do something before you are added as a party, you get treated the same as everyone else.
